Oil prices dip below $99 a barrel (AP)

NEW YORK ? Oil prices ended lower Monday on concerns that the U.S. economy could slow, and investors' worries eased about supply disruptions in the Persian Gulf.

Benchmark crude fell by 78 cents to finish at $98.78 per barrel in New York on Monday. Brent crude, which is used to price foreign oils that are imported by U.S. refineries, lost 71 cents to end at $110.75 per barrel in London.

The Commerce Department said Americans kept a tighter grip on their wallets in December. Consumer spending was flat, even though incomes rose by the most in nine months. The economy relies heavily on consumer spending, and analysts say the economic recovery could stall and energy demand may stay weak if spending doesn't pick up.

Meanwhile, Iran welcomed international weapons experts into the country in hopes of refuting claims that it is building a nuclear weapon. That eased concerns about possible military action in the region. Still, Europe plans to embargo Iranian oil this summer to pressure Iran about its nuclear program. If that happens, Iran says it could retaliate by blocking passage through the Persian Gulf, where tankers carry one-sixth of the world's oil exports.

The U.S. is ready to implement sanctions on Iran's central bank that will make it harder for Iran to sell oil.

Gasoline pump prices rose by a penny on Monday to $3.43 per gallon, according to AAA, Wright Express and Oil Price Information Service. A gallon of regular is 15.3 cents higher than it was a month ago and 33 cents higher than it was last year.

In other energy trading, heating oil fell 2 cents to finish at $3.05 per gallon and gasoline futures fell 6 cents to end at $2.87 per gallon. Natural gas futures fell 4 cents to end the day at $2.71 per 1,000 cubic feet.

These Guys Built a Crowd Investing Platform Even Though It's Not ...

betabeat.com
Adrianne Jeffries

It is illegal to invest $100 in a startup in exchange for equity or options unless you?re an accredited investor.

Still, a website for crowd investing launched today: WeFunder.com. Even though the law that would make it legal is still being debated in the Senate, TechStars alumni and Startup Workaway co-founders Nicholas Tommarello and Nick Plante went ahead and built WeFunder and wrote a business plan anyway.

?We?ve built out the crowd-investing platform in advance of the law passing, and have put in a lot of thought into how to best protect small investors,? Mr. Tommarello wrote in an email.

A disclaimer on the site reads:

Wefunder is a crowd-investing platform for startups. Until the current law is changed (hopefully soon!), our invite-only beta is only open to accredited investors.

?We?re only going to choose one startup a week to feature; artificial scarcity will drive up quality,? Mr. Tommarello said. ?And we will only choose startups with at least one accredited investor ? the idea is that angels perform due diligence and professional mentorship, the crowd can throw in up to $1 million afterwards. That delays the date an A round is needed, enhancing founder control.?

Davis, Dujardin win lead honors at SAG awards (AP)

LOS ANGELES ? Viola Davis and Octavia Spencer were the maids of honor at Sunday's Screen Actors Guild Awards, where their Deep South drama "The Help" won them acting prizes and earned the trophy for overall cast performance.

Davis won as best actress and Spencer as supporting actress for "The Help," while Jean Dujardin was named best actor for the silent film "The Artist" and Christopher Plummer took the supporting-actor award for the father-son tale "Beginners."

The wins boost the actors' prospects for the same honors at the Feb. 26 Academy Awards.

In "The Help," Davis and Spencer play black maids going public with uneasy truths about their white employers in 1960s Mississippi.

"I just have to say that the stain of racism and sexism is not just for people of color or women. It's all of our burden, all of us," Davis said, accepting the ensemble prize on behalf of her "The Help" co-stars.

Accepting her best-actress award, Davis singled out two performers in the audience who inspired her early in her career: "The Help" co-star Cicely Tyson and Meryl Streep, Davis' co-star in the 2008 drama "Doubt" and one of the nominees she beat out for the SAG prize. Streep had been nominated as Margaret Thatcher in "The Iron Lady," a role that won her the dramatic actress award at the Golden Globes over Davis.

A French film star who is a newcomer to Hollywood's awards scene with "The Artist," Dujardin played a silent-era screen idol fallen on hard times as talking pictures take over in the late 1920s.

"I was a very bad student. I didn't listen in class. I was always dreaming," Dujardin said. "My teachers called me `Jean of the Moon,' and I realize now that I never stopped dreaming. Thank you very much. Thank you for this dream."

Plummer would become the oldest actor ever to win an Oscar at age 82, two years older than Jessica Tandy when she won best actress for "Driving Miss Daisy."

Backstage, Plummer joked when asked if he would like to win an Oscar, an honor so elusive during his esteemed 60-year career that he did not even receive his first Academy Award nomination until two years ago, for "The Last Station."

"No, I think it's frightfully boring," Plummer said. "That's an awful question. Listen, we don't go into this business preoccupied by awards. If we did, we wouldn't last five minutes."

Spencer, a veteran actress who had toiled in small TV and movie parts previously, had a breakout role in "The Help" as a brassy maid whose mouth continually gets her in trouble.

"I'm going to dedicate this to the downtrodden, the under-served, the underprivileged, overtaxed ? whether emotionally, physically or financially," Spencer said.

On the television side, comedy series awards went to "Modern Family" for best ensemble; Alec Baldwin as best actor for "30 Rock"; and Betty White as best actress for "Hot in Cleveland."

"You can't name me, without naming those other wonderful women on `Hot in Cleveland,'" the 90-year-old White said. "This nomination belongs to four of us. Please, please know that I'm dealing them right in with this. I'm not going to let them keep this, but I'll let them see it."

The TV drama show winners were: Jessica Lange as best actress for "American Horror Story"; and Steve Buscemi as best actor for "Boardwalk Empire," which also won the ensemble prize.

For TV movie or miniseries, Kate Winslet won as best actress for "Mildred Pierce," while Paul Giamatti was named best actor for "Too Big to Fail."

Before the official ceremony, the Screen Actors Guild presented its honor for best film stunt ensemble to "Harry Potter and the Deathly Hallows: Part 2." The TV stunt award went to "Game of Thrones."

The winners at the SAG ceremony often go on to earn Oscars. All four acting recipients at SAG last year later took home Oscars ? Colin Firth for "The King's Speech," Natalie Portman for "Black Swan" and Christian Bale and Melissa Leo for "The Fighter."

The same generally holds true for the weekend's other big Hollywood honors, the Directors Guild of America Awards, where Michel Hazanavicius won the feature-film prize Saturday for "The Artist." The Directors Guild winner has gone on to earn the best-director Oscar 57 times in the 63-year history of the union's awards show.

The guild's ensemble prize, considered the ceremony's equivalent of a best-picture honor, has a spotty record at predicting what will win the top award at the Oscars.

While "The King's Speech" won both honors a year ago, the SAG ensemble recipient has gone on to claim the top Oscar only eight times in the 16 years since the guild added the category.

Though "The Help" won the ensemble prize this time, "The Artist" and George Clooney's family drama "The Descendants" are considered stronger contenders for the best-picture Oscar.

Both "The Artist" and "The Descendants" also were nominated for writing and directing Oscars, categories where serious best-picture candidates generally need to be in the running. "The Help" missed out on nominations in both of those Oscar categories.

Mary Tyler Moore received the guild's lifetime-achievement award, an honor presented to her by Dick Van Dyke, her co-star on the 1960s sit-com "The Dick Van Dyke Show."

SAG President Ken Howard put in a plug during the show for the guild's planned merger with another Hollywood union, the American Federation of Television and Radio Artists. The boards of both groups have approved the merger, and ballots will be sent to members of each union.

"As one union, SAG-AFTRA will support a future of great entertainment for all of us," Howard said.

'Dark Knight Rises': Who Is Joseph Gordon-Levitt Really Playing?

Is John Blake the next Dark Knight, Robin or someone else entirely? We discuss in The Weekly Rising.
By Kevin P. Sullivan

Joseph Gordon-Levitt films a scene of "Dark Knight Rises"

Who the hell is John Blake?

It was the question most of us asked when Joseph Gordon-Levitt joined the cast of "The Dark Knight Rises" last year. The little bit Warner Bros. told us labeled Blake as "a Gotham City beat cop assigned to special duty under the command of Commissioner Gordon." It's not exactly the kind of character description you'd expect from such a big-name actor in one of Christopher Nolan's Batman films.

Such a nondescript character begs the question: Who is he really? We did the same last week with Marion Cotillard's Miranda Tate, and this week, we're taking a deep dive into just who this mysterious man in blue might be.

A short while after Warner Bros. revealed John Blake as a character in "The Dark Knight Rises," hard-core comic book nerds did their due diligence and found the one trace of the name that dates all the way back to 1942. Little Johnny Blake appears in an issue of "Batman," where Joker goes around making the people of Gotham cry, one citizen at a time. Poor Johnny Blake had just received a great report card, but the Joker comes along and snatches it. Now Dad will never believe him!

If we're going to speculate, it's safe to assume that Nolan won't surprise everyone with a gritty, realistic take on the whole "stolen report card" story line. There's no hard evidence other than the shared named that Gordon-Levitt's John Blake has anything to do with the unfortunate, terrorized little boy from the comics.

With the source material more or less a dead end, that leaves the vague official character description and two of the Internet's favorite theories. One posits that Blake will be a much more rugged Robin. Another hypothesizes that he will don the Batman cowl after Bruce Wayne dies or retires.

Fans have been quick to cry "Robin!" since "Batman Begins." (What's the Dark Knight without his young ward, after all?) But there is nothing that Nolan has been as adamant about as his conviction to never feature the Boy Wonder in his Batman films. Yet, Robin champions abide, even finding false clues of his presence in the "Dark Knight Rises" trailer. Nolan said he won't include Robin, so there's little reason to suspect him of doing anything else.

More daring theorists guess that Blake will go through the majority of the movie as the beat cop he's described to be but eventually become the new Batman once Wayne is out of the picture, either due to injury or — gulp — death. Supporters of this theory point to Bane's legacy of destroying Batman and Wayne's use of a cane in the trailer.

I find myself not only favoring the second theory, but actively hoping that it comes to fruition. So much of the lead-up to the film has centered on the idea of "the legend." Ra's Al Ghul speaks in the trailer about Wayne becoming more than a man. "The Legend Ends" even adorns the most recent poster, yet the two messages directly contradict each other. If Wayne commits himself to an ideal, he'll become an unstoppable legend, and the entire concept of Batman demands that the legend cannot end. What better way to prove that point than to break Wayne, remove the man and yet have the legend continue?

Gordon-Levitt's inclusion in the cast essentially requires Blake to play a major role, more than any official description would allow him. Bet on Blake being a big part of the film, but what the role may entail will only be answered in July.

Myanmar's Suu Kyi makes political tour in south (AP)

DAWEI, Myanmar ? Thousands of supporters in Myanmar's countryside cheered opposition leader Aung San Suu Kyi on Sunday as she made a political tour ahead of by-elections, highlighting how quickly and dramatically politics is changing in the long-repressed Southeast Asian nation.

Throngs of people lined the roads of several towns in the southern district of Dawei shouting, "Long Live Daw Aung San Suu Kyi!" "Daw" is a title of respect in Myanmar.

Many waved bouquets of flowers, and some hoisted babies on their shoulders to glimpse the Nobel Peace Prize laureate and former political prisoner on her first political trip since announcing a bid for parliament.

"We will bring democracy to the country," Suu Kyi told an exuberant crowd of thousands. "We will work for development. We will bring rule of law to the country, and we will see to it that repressive laws are repealed."

"We can overcome any obstacle with unity and perseverance," she said from the second-story balcony of a provincial office for her National League for Democracy party.

Suu Kyi, 66, has devoted much of her life to a struggle against authoritarian rule, but spent 15 of the past 23 years under house arrest and has never held elected office. If she wins, she is likely to have limited power in the legislature, which remains dominated by the military and the ruling party, but victory would be highly symbolic and give her a voice in government for the first time.

The one-day trip to Dawei follows a series of unprecedented reforms enacted by the nominally civilian government that took over when a military junta ceded power last year. The government has released hundreds of political prisoners, reached cease-fire deals with ethnic rebels, increased media freedoms and eased censorship laws.

The April 1 by-election is being held to fill 48 seats in the lower house of parliament that were vacated after lawmakers were appointed to the Cabinet and other posts.

Suu Kyi's party boycotted the last vote in 2010, but registered earlier this month for the by-election after authorities amended electoral laws, enabling her party to legally participate.

The Election Commission must still accept Suu Kyi's candidacy. A ruling is expected in February.

Suu Kyi is hoping to run as a representative of the constituency of Kawhmu, a poor district just south of Yangon where villagers' livelihoods were devastated by Cyclone Nargis in 2008.

The vote is being closely watched because it is seen as a crucial test of the government's commitment to change.

Suu Kyi, who won the Nobel Peace Prize in 1991 for her nonviolent struggle for democracy, has rarely traveled outside Yangon, the country's main city, over the last two decades.

Although she conducted one successful day of rallies in two small towns north of Yangon last August, a previous political tour to greet supporters in 2003 sparked a bloody ambush of her convoy that saw her forcibly confined at her lakeside home.

Suu Kyi was finally released from house arrest in late 2010, just days after the country's military rulers held elections widely viewed as neither free nor fair.

In Dawei, a coastal district south of Yangon, Suu Kyi was garnering support for another candidate running for a parliament seat, party spokesman Nyan Win said.

She will make similar campaign trips to other areas, including the country's second-largest city, Mandalay, in early February before campaigning for her own seat, Nyan Win said.

Dawei is home to activists who recently helped persuade the government to ditch construction of a 4,000-megawatt coal-fired power plant over environmental concerns.

A 400-megawatt coal plant is still planned, however, because it will be needed to power a massive industrial complex project that includes construction of a deep sea port, a steel mill and a petrochemical plant. The project also includes railroads and highways that will connect Myanmar's coast directly to Thailand and the rest of Southeast Asia.

Banners with Suu Kyi's pictures decorated the area.

"People had been afraid to discuss politics for so long," said Aung Zaw Hein, an environmental activist whose Dawei Development Association helped stop the huge power plant. "Now that she's visiting the political spirit of people has been awakened."

Chevron's 4Q profit drop highlights hurdles ahead (AP)

NEW YORK ? Satisfying the world's growing energy appetite isn't easy.

Chevron Corp., which has spent more than $20 billion a year since 2007 scouring the globe for new resources, said Friday that it is struggling to produce more oil and natural gas. Production levels last year were the lowest since 2008.

The company still expects to supply more oil in the future, but its troubles last year highlight the many hurdles the industry faces as industrial and developing nations crave more oil to grow their economies.

The U.S. predicts that oil producers will fall behind as global demand ratchets up. The Energy Information Administration estimated that the world used 88.1 million barrels of oil per day in 2011 while producing only 87.6 million barrels per day. It sees the trend continuing this year and next. Oil and gasoline prices are expected to rise as countries dip into stockpiles to cover shortfalls.

In the U.S., drivers will probably pay more for gas this year. Experts think pump prices could hit $4 by spring and stay close to that for the rest of the year.

"Can we meet demand? Maybe. But doing so is going to be more challenging and expensive," Argus Research analyst Phil Weiss said.

Part of the drop in Chevron's 2011 production can be explained by contracts with foreign governments that limit the amount of crude that Chevron can keep as prices rise. Chevron also is dealing with a rash of troubles at its fields and facilities around the world.

There were pipeline problems this year in Thailand, tropical storms in the Gulf of Mexico and equipment issues in the United Kingdom.

An offshore oil leak put Chevron at odds with the Brazilian government. Regulators there forced Chevron to shut down one of its offshore wells in December, and prosecutors are seeking $10.6 billion in damages. Chevron has voluntarily suspended plans to further explore the country's oil-rich offshore region.

The company also is in an ongoing battle with Ecuador over environmental damages from oil production operations by Texaco that took place in the country more than two decades ago. Chevron bought Texaco in 2001.

In the fourth quarter, Chevron Corp.'s profits slipped by 3.2 percent to $5.12 billion, or $2.58 per share. The results fell short of Wall Street forecasts of $2.86 per share, and shares dropped $2.63, or 2.5 percent, to close at $103.96.

Profits from Chevron's exploration and production business increased, despite weaker production, because the company sold oil at higher prices. International natural gas prices also rose in the quarter.

Despite the 2011 slowdown, Chevron's future production still looks "on track to meet our goals," Chairman and CEO John Watson said. The company expects to pump 3.3 million barrels per day by 2017, a 23.5 percent increase from 2011 levels.

Chevron's refining business struggled, as falling prices for retail gasoline and other fuels made it harder to pass along higher oil costs to customers. Chevron's U.S. refining operations lost $204 million from October to December. International refining profits fell by 46.4 percent.

For the full year Chevron earned $26.9 billion, or $13.44 per share, compared with $19 billion, or $9.48 per share in 2010. Annual revenue increased 23.3 percent to $253.7 billion.

Earlier in the week, ConocoPhillips reported a 66 percent increase in quarterly earnings, though much of that came from the sale of a pipeline and other assets. ConocoPhillips said its production fell 8 percent last year while it aggressively shed assets. Occidental Petroleum Corp. said it increased oil production about 4 percent last year while boosting profits 35 percent in the final three months of the year.

Exxon Mobil Corp. and Royal Dutch Shell are expected to announce their fourth-quarter results next week.

Thousands rally for Putin in Russian industrial belt (Reuters)

YEKATERINBURG, Russia (Reuters) ? Thousands of supporters of Russian Prime Minister Vladimir Putin rallied on Saturday to back his bid to return to the Kremlin, a week before what are likely to be far larger opposition protests to demand greater political choice.

Police said around 10,000 people gathered in Yekaterinburg, Russia's fourth-largest city, with many brought on buses and trains from outlying towns in the Urals industrial belt to back Putin before the March 4 presidential vote.

Putin enjoys strong support in many Russian regions, but faces criticism from the urban middle class, especially in Moscow and St Petersburg. Effectively excluded from mainstream politics, middle class Russians have taken to the Internet to call for sweeping electoral reform.

Tens of thousands people from different parties and others, unaffiliated to any political organization, are expected to take part in a protest march on Feb 4 to press "For fair elections" in Moscow, which was approved by the city's authorities.

Tens of thousands protested in Moscow and other cities in December calling for a December 4 parliamentary election to be re-run, alleging the ruling United Russia party's victory was achieved through widespread ballot fraud.

In Yekaterinburg, demonstrators held placards with slogans such as 'We are for a stable tomorrow', swayed to pop music and enjoyed free food and drink.

"Buses were laid on for us at the factory, we saw lists in advance of those who would go to the rally," said Andrei Mandure, a worker at a chemical plant in the town of Lesnoy, a closed facility during the Soviet era. Putin did not attend the rally.

Public-sector workers were also out in the city's railway station square. One, a 59-year-old kindergarten worker who gave her name as Yevgeniya, told Reuters her boss had instructed her to attend.

Putin, president from 2000-08, is aiming to secure a further six-year term in March. He holds a clear lead in opinion polls, with Communist Gennady Zyuganov running a distant second.

The exclusion of liberal Grigory Yavlinsky from the slate on a technicality has further angered the opposition, which says the Kremlin has allowed billionaire Mikhail Prokhorov to run to capture protest votes without posing a threat to Putin.

"There are no good candidates. Yavlinsky was banned ... (so) who else if not Putin?" said Sergei, a 46-year old from Kirovgrad, when asked who he would vote for in March.

(AP) ? Rescue workers feverishly dug through the wreckage of three downtown buildings Friday, hunting for survivors of a collapse that killed at least 12 people and left 17 more missing, police and municipal authorities said.

Officials believe unauthorized construction work inside a 20-story, 72-year-old building damaged its structure and caused it to crumble, wrenching down two neighboring office buildings of approximately the same age about 8:30 p.m. Wednesday.

Police investigators were interviewing the buildings' tenants and workers, including construction worker Alexandro Fonseca, who was inside an elevator when the tallest building fell, but was pulled from the wreckage alive.

Fonseca told news media gathered at the site that workers had removed several walls on the ninth floor, but said that didn't affect the building's infrastructure. He didn't know if there was an engineer in charge of the project.

Rio's Regional Council of Engineering has said the last time they authorized refurbishing in the building was in 2008. But Mayor Eduardo Paes said a license from city hall is not required for internal construction projects, and the responsibility for such projects lies "exclusively in the hands of workers."

Paes said at a news conference Thursday night that the focus would remain on saving lives and supporting the families of victims. There were 390 workers searching the site, and more than 400 truckloads of debris had been removed, according to the mayor's office.

The head of Rio state's Civil Defense agency said the hunt for survivors will continue for 48 hours more.

City officials said the accident should not cast doubt on Rio's ability to organize and host the upcoming Olympics and World Cup.

"This was an isolated incident that occurred on private property," the mayor's office said in a statement. "The case is entirely unrelated to the preparations for the 2014 World Cup, the 2016 Olympic Games and other events that are already part of the city's calendar."

The families of the missing spent the night in a nearby government building, holding out increasingly slim hopes. Some relatives recognized belongings of victims as workers picked through hundreds of thousands of tons of rubble.

Searchers pulled out Alessandra Alves Lima's purse. Nearby they found the ID card of Edson Menezes. A dentist saw some of the computer material from his office being carried from the site.

Other family members got nothing: no news, no sign of their loved ones.

Afonso Celso Menezes rushed to the site after being alerted by a cousin that the building where his sister worked had crumbled. He didn't want to leave without news of Kelly Menezes. She worked in finance and stayed late closing the month's books in the 20-story building, which housed several accounting offices. By Friday, there was no sign of the 28-year-old.

The office buildings in Rio's historic center were full of a wide range of businesses. Most tenants were gone by the time of the collapse Wednesday, but some had remained to finish leftover work. Several of the missing were in a computing course.

Roche's Avastin helps colorectal cancer patients (Reuters)

ZURICH (Reuters) ? Patients with advanced colorectal cancer who received Roche's Avastin live longer when they also receive the drug as part of their second round of treatment, the Swiss drugmaker said on Thursday, citing a late-stage study.

Patients with metastatic colorectal cancer first treated with Avastin and standard chemotherapy before being given Avastin with a different chemotherapy after their disease had progressed lived significantly longer than those given only chemotherapy in the second-line setting, Roche said.

The news is likely to boost sentiment around the drug, which recently suffered a major setback when U.S. authorities decided to revoke their backing of its use in breast cancer.

Roche will submit the results of the ML 18147 study at an upcoming medical meeting.

In Europe, Avastin is currently approved in colorectal, lung, renal, breast cancer and it has just won approval in ovarian cancer.

Nintendo posts loss on strong yen, weak sales (AP)

TOKYO ? Nintendo Co. sank to losses for the April-December period, battered by a price cut for its 3DS handheld, a strong yen that erodes overseas earnings and competition from mobile devices such as the iPhone that offer games-on-the-go.

The Japanese video game machine maker behind the Super Mario and Pokemon franchises said Thursday it now expects to sell far fewer of its 3DS machines, which feature three-dimensional images. It is forecasting sales of 14 million machines for the fiscal year through March 2012, down from an earlier 16 million. That's despite a price cut for the 3DS in August.

Nintendo, which also makes the Wii home console, posted a loss of 48.35 billion yen ($627.9 million) for the first nine months through December. That was a reversal from a 49.56 billion yen profit the same period in 2010. Nintendo did not break down quarterly numbers.

The company said it will have Wii U, the successor to the Wii, ready in time for the year-end holiday season. Earlier, it had said the machine, which has a touch-screen controller, will go on sale in the latter half of this year. But some had been skeptical whether it would be ready. Nintendo hasn't announced prices.

Kyoto-based Nintendo also lowered its annual earnings forecast to a 65 billion yen ($844 million) loss, much larger than the 20 billion yen ($260 million) loss projected earlier. It posted a 77.62 billion yen profit the previous fiscal year.

Nintendo's past success has come from the appeal of its products to so-called casual gamers ? people who now turn to smartphones and tablet devices such as the iPad from Apple Inc. to enjoy games.

The demand for the Wii has also diminished in recent months.

Nintendo is now expecting to sell 10 million Wii machines in the year ending March, down from an initial estimate of 13 million, which was revised lower to 12 million in July.

Nintendo's nine-month sales dropped 31.2 percent to 556.17 billion yen from the same period the previous year.

The numbers are a disappointment as they include the key year-end holiday season.

"Sales of the 3DS were strong in Japan, but Christmas shopping got to a late start overall in the U.S. and Europe," said Nintendo spokesman Yasuhiro Minagawa. "But we are upbeat about hardware and software sales for next fiscal year."

Worldwide sales of the 3DS for the nine months totaled 11.43 million, the company said. Game software for the 3DS like "Super Mario 3D Land" became million sellers, but games from outside companies did not fare as well, it said.

Competition in portable gaming is heating up with the arrival of the PlayStation Vita from Japanese electronics and entertainment company Sony Corp. Vita went on sale in Japan in December and next month in the U.S. and Europe.

Nintendo has continuously outpaced Sony in portable game sales with its hit DS machines.

The strong yen has also hurt Nintendo's bottom line. The dollar has been trading at about 77 yen lately, down from about 83 yen a year earlier.

Nintendo stock slid 0.6 percent to 10,790 yen in Tokyo.

Gingrich reveals income, but not how he earned it

(AP) ? Former House Speaker Newt Gingrich beat his main GOP presidential rival, Mitt Romney, to the punch by releasing his most recent tax return. But Gingrich still hasn't revealed how he earned most of his $3.1 million.

The 2010 tax return made public last week shows that $2.4 million, more than three-fourths of Gingrich's income, came in payments he regularly received, in addition to his salary, from different businesses he ran before announcing his candidacy for president. Those businesses managed speaking engagements, appearance fees, consulting work, book and video deals and paid positions that Gingrich held in other groups.

Gingrich, who has demanded more transparency from Romney, doesn't identify where the money came from, including amounts he received from his consulting business.

The Associated Press requested details about Gingrich's income and the identities of who paid him for his services. The campaign has not decided whether it will release further information about Gingrich's income, spokesman R.C. Hammond said.

Other GOP presidential candidates, including Romney and former Pennsylvania Sen. Rick Santorum, have provided details of such income. Romney's financial reports filed last year and his 2010 tax return released this week specify groups that paid him for appearances and how much he received. Santorum, who has yet to release his tax return, lists on a financial report the businesses that paid him as a consultant, payments he received serving on specific boards and activist groups, and money he earned as a FOX News contributor and a newspaper columnist.

The way Gingrich has earned a living in recent years has become an avenue for political attack by Romney. Romney charges that the $1.65 million Gingrich received from the government-backed mortgage company Freddie Mac from 1999 to 2007 was for influence peddling, which Gingrich has denied. Romney also has demanded that Gingrich identify other clients who paid for his services and what he did for them, accusing Gingrich of "potentially wrongful activity."

"If you're getting paid by health companies, if your entities are getting paid by health companies that could benefit from a piece of legislation, and you then meet with Republican congressmen and encourage them to support that legislation, you can call it whatever you'd like. I call it influence-peddling," Romney told Gingrich.

Gingrich has accused Romney of attacking his consulting work out of political desperation, hoping to stifle Gingrich's rising popularity among GOP voters. Gingrich said he has never been a lobbyist.

But he is battling the perception that he was selling his influence, if not actually lobbying, as he campaigns to win Florida's GOP presidential primary on Tuesday. Gingrich has said he was exercising his rights as a citizen, not a lobbyist, in 2003 when he publicly advocated changes in Medicare. And he's argued that he and his group, which received millions from dozens of health-related businesses, made sure not to cross the line into lobbying when he met with congressional members and others to promote the Medicare changes sought by then President George W. Bush.

A liberal-leaning watchdog group, Citizens for Responsibility and Ethics in Washington, is urging a federal investigation of Gingrich's activities.

"Mr. Gingrich's claim that he simply engaged in 'public advocacy' doesn't pass the smell test," said Melanie Sloan, the group's executive director. "Mr. Gingrich was a lobbyist, and he should not be allowed to play word games with the American people."

To make its case that Gingrich was lobbying, Sloan's group cites the Lobbying Disclosure Act, which defines a lobbyist as someone who receives payment for services from a client, makes more than one lobbying contact for the client on an issue and spends at least 20 percent of their time in a three-month period on lobbying activities. A lobbying contact is defined as communication on behalf of a client regarding "the formulation, modification or adoption of federal legislation."

Gingrich's tax return doesn't show how much money he received as a consultant working through his Gingrich Group and his Center for Health Transformation. The center urges changes to health-related policies and laws, practices and technology but says it "does not provide lobbying services nor directly or indirectly participate in lobbying activities of any kind." Instead, all of Gingrich's income is lumped together as $2.4 million in payments from Gingrich Holdings, a sort of parent company managing his interests in other businesses.

The Center for Health Transformation served more than 100 companies in 2010, with some paying as much as $200,000 a year to join Gingrich's organization. While the center has said it generated $55 million from hundreds of corporate sponsors from 2001 to 2010 with Gingrich leading the effort, it said it won't release a list of clients due to confidentiality clauses in its contracts.

Last year as he prepared for the presidential run, Gingrich sold his interest in the Gingrich Group and the Center for Health Transformation. He hasn't said how much he received in the buyout, but his financial disclosure form shows his Gingrich Productions is owed between $5 million and $25 million from the Gingrich Group.

Gingrich's tax return also doesn't show how much he received from his Fox News contract as a frequent on-air contributor. That contract was managed by Gingrich Communications, a business that handles his appearances and speaking engagements.

Last fall when Gingrich was first denying ever working as a lobbyist, he told a South Carolina audience that he didn't need to walk the halls of Congress to make a living because of the bounty he received in speaking fees.

"I'm going to be really direct, OK? I was charging $60,000 a speech. And the number of speeches was going up, not down," he said.

Gingrich has not identified the groups that paid him for those speeches.

Gingrich also continued to earn money as an author, although it's not clear how much of his earnings came from payments received by Gingrich Communications from his books.

While the $2.4 million in Gingrich's business payments are not detailed, the tax return does identify more than $712,000 of other income:

?$252,500 for his salary from Gingrich Holdings;

?$191,827 for his wife's salary from Gingrich Productions and $5,918 from the Basilica of the National Shrine of the Immaculate Conception in Washington as a member of the church's professional choir;

?$76,200 for his congressional pension;

?$72,274 from his share of his daughter's business;

?$38,637 for dividend and interest payments;

?$33,124 in tax refunds;

?$21,625 in speaking fees paid directly to Gingrich and not his businesses;

?$20,000 for him and his wife for serving on boards of directors. The boards are not identified.

How the Glock Became America's Favorite Weapon [Guns]

I know next to nothing about guns but I know about the Glock. Chances are you do too. It's become a part of the American fabric, as closely associated to the US of A as AK-47s are to terrorists, muskets were to colonials and light sabers to Jedis. But how did that happen? How did an Austrian gun become America's favorite weapon? More »

Obama: US must reclaim values of fairness for all (AP)

WASHINGTON ? Keeping the American dream alive has become "the defining issue of our time," President Barack Obama says. He's using Tuesday night's State of the Union address to draw a stark election-year line with Republicans over how to keep the United States from eroding further into a nation of haves and have-nots.

In excerpts of his speech released in advance, Obama attacked income equality and offered his own economic revival plan built upon boosting manufacturing, energy and education. He warned Republicans in Congress that he will fight them if they try to obstruct him or restore an economy gutted by "outsourcing, bad debt and phony financial profits."

Driving everything about the speech: Jobs, including Obama's own. He was essentially making his case for re-election as he spelled out where he wants to take the country.

Obama was making his pitch to a bitterly divided Congress and to a country underwhelmed by his handling of the economy. Targeting anxiety about a slumping middle class, Obama was calling for the rich to pay more in taxes. Every proposal was to be underlined by the idea that hard work and responsibility still count.

"No debate is more important," Obama said in the excerpts released by the White House ahead of the 9 p.m. EST speech.

"We can either settle for a country where a shrinking number of people do really well while a growing number barely get by. Or we can restore an economy where everyone gets a fair shot, everyone does their fair share and everyone plays by the same set of rules," the president said.

ThreatMetrix: Mobile buying less risky than desktop this holiday season (Digital Trends)

ThreatMetrix desktop v mobile risky transactions

Cybercrime prevention solution provider ThreatMetrix has released their assessment of the risk levels associated with online commerce transactions during the 2011 holiday season, and finds on average mobile transactions were less risky overall than transactions conducted from desktop (or notebook) computers. From businesses? point of view, this means that mobile transactions might be less chancy than traditional online sales; for consumers, it might mean that businesses increasingly try to shift online purchasing to mobile platforms as a way to reduce their risk.

ThreatMetrix doesn?t go into any detail about what makes a transaction qualify as ?risky,? ?somewhat risky,? or ?very risky,? but the overall pattern for December 2011 is consistent across both mobile and desktop platforms, with a significant uptick in the number of potentially-fraudulent transactions leading up to and immediately following Christmas Day. Nonetheless, the findings are likely to be particularly interesting to businesses considering how to augment their e-commerce strategies?especially since online holiday spending is steadily increasing. (For instance, comScore reported online holiday spending was up 15 percent in 2011 to over $35 billion.)

?Online commerce is becoming a preferred channel, as its convenience and oftentimes competitive pricing are appealing factors to today?s consumers,? said ThreatMetrix?s chief product officer Alisdair Faulkner, in a statement. ?As businesses continue to build a cross-channel presence, it?s essential they understand the inner workings of the fraud network to effectively prevent cybercrime.?

The ?fraud network? noted by Faulkner refers to professional networks that specialize in online fraud, spanning spam, online gaming, social networking, e-commerce, and online banking. Where online fraud used to be dominated by individuals and small groups, ThreatMetrix maintains a major threat now is networked groups of criminals, each specializing in a different phase or step of committing online fraud, whether it be setting up fake social networking accounts, infecting vulnerable PCs, testing stolen credit card data, and placing bogus online orders for goods that are then resold. And they may be racking up more per theft: CyberSource?s 2011 Fraud Report puts total losses from online fraud totaling $3.4 billion for 2011, which is the first time there?s been an uptick in revenue lost to fraud since 2004. However, overall, CyberSource found online fraud was down from 0.9 percent of orders in 2010 compared to 0.6 percent in 2011.

The comparative safely?or, at least ?less risk??associated with mobile commerce might be a temporary phenomena, however. Where significant online commerce has been conducted via traditional Web browsers for the better part of two decades, the mobile commerce world is comparatively new territory for fraudsters. Where vendor and carrier lock-in may be effective tools for dissuading simplistic types of fraud?or at least being able to associate it with individual mobile users?there?s nothing about a mobile Web browser or app that makes it magically less able to (say) send stolen credit card information to businesses. It?s also possible mobile commerce just hasn?t been a big enough target for fraudsters to seriously target: even with the 2011 holiday season seeming a watershed for placing orders via tablets and smartphones, IBM found mobile devices still only accounted for 14.6 percent of all online commerce sessions.

Germany and France seek relaxation of bank capital rules: report (Reuters)

LONDON (Reuters) ? France and Germany will call on Monday for a relaxation of global bank capital rules to prevent lending to the real economy being choked off, the Financial Times reported on Monday.

German finance minister Wolfgang Schauble and his French counterpart Francois Baroin will urge special treatment for banks that own insurance companies, according to a joint paper seen by the newspaper.

The pair will also urge important elements of the Basel III guidelines on capital requirements to be watered down to mitigate any "negative effect" on growth, according to the article.

The FT said the paper calls for a three-year delay to the mandatory deadline to disclose leverage ratios, a measure of bank borrowing and risk.

Banks across the world will have to follow Basel III accords for disclosing the size and quality of their capital safety buffers from 2013 to help reassure investors they are stable.

Sundance new normal - strong films, cautious, steady buying (Reuters)

PARK CITY, Utah (TheWrap.com) ? The Sundance action got under way over the weekend with numerous films sold or about to be sold, and indie buyers impressed by a crop of what they called intelligent and thoughtful films.

It seems that the independent film world has finally gotten used to the new normal of the challenged marketplace, and are responding.

"There's a sense of seriousness about the movies this year and in the meetings that we're having with agents and filmmakers," said Michael Barker, the co-chairman of Sony Pictures Classics, in an interview with TheWrap.

He added: "There's a loss of the huckster veneer that we've come to expect from this place. The feeling among us and the filmmakers and sellers this year is that we're all in this together. I see a lot less of the vestiges of the cutthroat business that used to be."

Sellers seemed to agree. Buyers were aggressively circling the hot movie of the moment, "Beasts of the Southern Wild," a trippy, original take on environmental apocalypse set in something akin to the levees of New Orleans.

But those involved in the film said the focus was on finding the right distributor for an unusual project.

"This has elements of an auction, but we're trying to create careful listening," said one person involved in the sale who spoke on condition of anonymity. "Buyers are saying: 'Let's take a chance.'"

That film, to be sure, will be a tricky sell at the theater -- it features a pint-sized New Orleans girl and prehistoric beasts.

Among the other movies that were on the block or sold:

* "The Words," a drama starring Brad Cooper, Zoe Saldana and Jeremy Irons, sold to CBS Films for $2 million with a $1.5 million commitment in prints and advertising, according to a knowledgeable individual.

* "Arbitrage," the New York drama set amid high society and Wall Street finance and starring Richard Gere, was poised to sell within the next day or so.

* "Celeste and Jesse Forever" had four offers by late Sunday, according to a knowledgeable insider. The film stars Rashida Jones and Andy Samberg as two friends who met in high school, married young - and divorce.

* "Black Rock," a thriller about three friends who reunite for a girls' weekend getaway on a remote island that goes horribly awry, stars Katie Aselton alongside Lake Bell and Kate Bosworth. It sold to Mickey Liddell's LD Entertainment.

There was strong, positive response to "Liberal Arts," a charming story set in the world of higher education by writer-director-star Josh Radnor. The movie, which won loud cheers and applause at the Eccles Theater on Sunday afternoon, also stars last year's Sundance "It Girl" Elizabeth Olsen and Richard Jenkins.

Several documentaries were sold, including the audience favorite "Searching for Sugar Man" and the real estate doc "Queen of Versailles."

"There have been some commercial films, and some that are more challenging," said Eric d'Arbeloff, co-chief of Roadside Attractions, in an interview with TheWrap. "But you can't forget that the ones that are the least commercial are sometimes the ones that have the most potential for us."

A hangover remains from distributors who overpaid last year. Prices ratcheted as high as $6 million then, in many cases for films that brought little return.

"The marketplace is smart," said Jay Cohen, who runs Gersh's independent film department. "People are not going to do what they did last year -- spend a lot of money for movies that are not commercial."

Most important to sellers, he said, is the capital commitment to marketing. "That is the key to everything," he said.

Meanwhile, a shadow remained over the festival at the news that Bingham Ray, an independent film veteran and close friend of many at the festival, had suffered a stroke and was in the hospital.

People were shaken at the news, and concern over his condition rippled through many conversations. (Steve Pond contributed to this report)

Dropped heart successfully transplanted in Mexico (AP)

MEXICO CITY ? A heart that was dropped on the ground while being transported to a hospital has been successfully transplanted into a 28-year-old hair stylist.

Dr. Jaime Saldivar says Erika Hernandez doesn't yet know that her new heart made national news when a medic stumbled and the plastic-wrapped heart tumbled out of a cooler onto the street two weeks ago.

Saldivar says it will be up to the family to tell her.

A rosy-cheeked Hernandez spoke briefly with reporters on Tuesday and thanked the donor's family, saying "I have no words to express how happy I am."

Hernandez was born with a congenital heart defect. She received the heart of a man who died in a car accident.

Tears, joy as woman sets Antarctic crossing record (AP)

BUENOS AIRES, Argentina ? British adventurer Felicity Aston became the first woman to ski alone across Antarctica on Monday, hauling two sledges around crevasses and over mountains into endless headwinds, past the South Pole and onward to the coastal ice shelf, persevering for 59 days in near-total solitude.

She made it to her destination ahead of schedule, using nothing but her own strength to cover 1,084 miles (1,744 kilometers) from her starting point on the Leverett Glacier on Nov. 25 to Hercules Inlet.

The most surprising thing about her journey, she said, was how emotional it proved to be, from the moment she was dropped off alone, through every victory and defeat along the way.

"I'm not a particularly weepy person, and yet anyone who has been following my tweets can see me bursting into tears," she said in an interview with The Associated Press on Monday while waiting for a plane to pick her up.

"When I saw the coastal mountains that marked my end point for the first time, I literally just stopped in my tracks and bawled my eyes out," she added. "All these days I thought there was no chance I was going to make it in time to make that last flight off Antarctica, and yet here I am with three days to spare."

Aston also set another record: the first human to ski solo, across Antarctica, using only her own muscles. A male-female team earlier skied across Antarctica without kites or machines, but Aston is the first to do this alone.

Aston, 34, grew up in Kent, England, and studied physics and meteorology. A veteran of expeditions in subzero environments, she worked for the British weather service at a base in Antarctica and has led teams on ski trips in the Antarctic, the Arctic and Greenland.

But this was the first time she traveled so far, so alone, and she said the solitude posed her biggest challenge. In such an extreme environment, the smallest mistakes can prove treacherous. Alone with one's thoughts, the mind can play tricks. Polar adventurers usually take care to watch their teammates for signs of hypothermia, which is easier to diagnose in others than yourself, she said.

She thought she was done for when her two butane lighters failed high in the Transantarctic Mountains, where it got "really very cold."

"Suddenly I realized that without a lighter working, I can't light my stove, I can't melt snow to make water, and I won't have any water to drink, and that becomes a very serious problem," she said. "It's quite stressful. It was just a matter of every single day, looking at my kit, and thinking what could go wrong here and what can I do to prevent it?"

She did have a small box of safety matches, and counted and re-counted every one until the lighters started working again at lower altitude, she said.

This Antarctic summer has seen the centennial of Roald Amundsen's conquest of the South Pole, where Britons still lament that R.F. Scott's team arrived for England days later, demoralized to see Norway's flag. Scott and his entire team then died on their way out, and some of their bodies weren't found for eight months.

Aston had modern technology in her favor: She kept family and supporters updated and received their responses via Twitter and Facebook, and broadcast daily phone reports online. She carried two satellite phones to communicate with a support team, and a GPS device that reported her location throughout. She also had two supply drops ? one at the pole and one part way to her finish line ? so that she could travel with a lighter load. Otherwise, her feat was unassisted.

While others have traveled farther using kites, sails, machinery or dogs (now banned for fear of infecting wildlife with canine diseases), she did it on her own strength.

"She's pretty average really, stands about 5-foot-6 I suppose, with an athletic build, but nothing outstanding," said Brian Dorsett-Bailey, a trustee with the British Antarctic Monument Trust. "It's only when you talk to her that she stands out. ... Whatever she wants to do, she'll do. She's a very determined lady."

Aston, whose journey also helped raise money for monuments to the 29 Britons killed on Antarctica since Scott, had to fight near-constant headwinds across the vast central plateau to the pole. Then she turned toward Hercules Inlet, pushing through thick, fresh snow, until she reached her goal on the Ronne Ice Shelf, a spot within a small plane's reach of a base camp on Union Glacier where the Antarctic Logistics and Expeditions company provides logistical support to each summer's expeditions.

With skies clearing Monday, Aston tweeted that she's been promised red wine and a hot shower after she gets picked up. "A very long, very hot shower," she emphasized. "It's something I haven't had in quite a long time now!"

From there, she'll join dozens of other Antarctic adventurers on the last flight out, a huge Russian cargo plane that will take her to Chile. Then she will fly home next week to Kent, in southeast England.

There, after two months of little but freeze-dried food, she can look forward to chicken pie, her mother said.

"I think there will be lots of cuddles, lots of hugs, it will be quite emotional," said Jackie Aston, 61.

Felicity Aston, pondering her last hours of solitude Monday, told the AP she felt both joy and overwhelming sadness at finishing.

"I'm still reeling from the shock of it that I've made it this far. I honestly didn't think I'd be getting here," she said.

What remains, she hopes, will be a message about perseverance.

"If you can just find a way to keep going, either metaphorically or literally, whether you're running a marathon or facing financial problems or have bad news to deliver or it's tough at work or whatever, if you can just find a way to keep going, then you will discover that you have potential within yourself that you never never realized," she said.

"Keeping going is the important thing, persevering, no matter how messy that gets. I mean, for me, sometimes I'll be sitting in my tent in the morning bawling my eyes out, having tantrums. It's not been pretty. But I've kept going, and that is the important thing because at some point in the future you'll look back and just be amazed at how far you've come."
